To Whom It May Concern:

 

Pursuant to the California Public Records Act (Government Code Section 6250 et seq.) ("CPRA”), and all other applicable laws, please disclose the following records.

The fundamental rule of the CPRA is a presumption of public access. “In other words, [A]ll public records are subject to disclosure unless the Legislature has expressly provided to the contrary.” Williams v. Superior Court, 5 Cal. 4th 337 (1993). This presumption finds further support in the California Constitution, as amended by Proposition 59 in 2004. “A statute, court rule, or other authority, including those in effect on the effective date of this subdivision, shall be broadly construed if it furthers the people's right of access, and narrowly construed if it limits the right of access.” Cal. Const. Art. 1 § 3(b)(2).

 

Please provide a determination on this request within 10 days of your receipt of it, and an even prompter reply if you can make that determination without having to review the records in question. If you determine that any or all of the information qualifies for an exemption from disclosure, please note whether, as is normally the case, the exemption is discretionary, and if so whether it is necessary in this case to exercise your discretion to withhold the information. If you determine that some but not all of the information is exempt from disclosure and that you intend to withhold it, please redact it for the time being and make the rest available as requested. In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any or all of the information is exempt and will not be disclosed. Please post the records to the City of Vallejo’s NextRequest website.

 

Please apply a fee waiver to this request. If the request for a fee waiver is denied, please provide notification of any duplication costs exceeding $20 before you duplicate the records. If the request for a fee waiver is denied, please further provide an index of all other requests since 2014 for which a fee waiver was denied, and the reason therefor.

Per your acknowledgement, the deadline to provide the annual benefits for FY 2018-2019 (as of 3/1/19) data requested for item 1f was extended to April 12, 2019 to allow staff more time to provide.  At this time, we are requesting an additional 2 week extension due to the complex system to gather the data from.  The new due date would be Friday April 26, 2019.  Please let me know if you accept this new extension.

I will check in with staff next week to determine a turnaround time to break out the overtime.  This may mean a further extension, as breaking out the overtime would mean reprocessing the data previously gathered as requested/provided.

Ah, we see. Thank you for the clarification. In that case, would it be possible to break overtime out into a separate column when the full records are released next month? We are trying to get as detailed a picture as possible now so we don't have to burden your office with subsequent clarifying requests. We can filter and process the data on our end, if it's sufficiently detailed. For us, granularity is better than summary (though we do need to have sufficient information to have, or find, the total compensation number). Thank you in advance.

On additional request — for the records being prepared for release on April 12, is it possible to include overtime pay? This was our oversight. We can put in a new request if need be, but we seek all of the salary, benefits and other information in the same spreadsheet, so it might be more efficient for all involved if overtime can be included here. We are willing to extend the due date if this request requires additional time to process. Please let us know if you can accommodate us. Thank you very much.

Hello, We will be happy to wait for the more complete disclosure. Thank you for the dialogue. Unfortunately, the budgeted salary and benefit data PDF is not readily convertible to a spreadsheet or database. Our attempts to do so have led to formatting errors, which in turn could lead to accuracy issues. We would appreciate it if those records could be disclosed in machine-readable format, pursuant to this request. Thank you again for all your help.

Pursuant to California Government Codes section 6253, the City of Vallejo shall, within 10 days from the receipt of the request, determine whether the request, in whole or in part, seeks copies of disclosable public records in the possession of the agency.

Under certain limited circumstances, the city may extend this time limit. With regard to your request, the City will make a determination by March 30, 2019 (14 additional calendar days from the day due). This extension is necessary due to a key staffing vacancy that has prevented the City from completing its diligent search for your requested records within the department, as well as the need to request additional resources not immediately available for an electronic search.

Dear Ms. Broaddus, Thank you for your very prompt response. We seek the budgeted salary amounts for each job classification in FY 2018–2019, along with the names of those who currently fill those positions. We understand some people may move on during that time. Since some people have already moved on this year (for example, the risk manager), an ideal disclosure would include both YTD and budgeted data, along with any dates of hire and separation. With regard to benefits, the same general principle applies: the more information, the better. If you would disclose the budgeted and actual amounts, as well as the employee and employer contributions in separate columns, that would be extremely helpful. We assume this is all readily available information that can be produced fairly readily. We are happy to filter and sort the data, so the more information that is disclosed, the better! That said, please let us know whether any of this is unduly burdensome. We are very much open to collaboration and dialogue. On that note, we wish to recognize your colleagues' conscientiousness, communication, and collegiality. Please keep these lines of communication open; we will do the same. Again, thank you.

Regarding the annual salary for FY  2018-2019, please clarify if you are looking for the annual salary for each employee's classification or their YTD earnings in FY 2018-2019?  If you are looking for the actual earnings, please note that FY 2018-2019 is not yet closed; as such, we can provide information through the most current pay period ending date of March 1, 2019.

Regarding the annual benefits for FY 2018-2019, please clarify if you are looking for the employer or employee paid portions?  Additionally, the same issue of timing applies; data provided would be available as of the pay period ending date of March 1, 2019.
