Re: Request under the Public Records Act


Dear Ms. Abrahamson:


Pursuant to the California Public Records Act, Government Code §§ 6250 et seq., this office
hereby requests copies, within ten (10) days, of the public records in the possession of the
City of Vallejo (hereinafter, the “City”) described below.


Definitions Used in this Request
“ALL” means each and every responsive RECORD or COMMUNICATIONS, regardless of
storage location or originating source, including private accounts and devices belonging to
City officials.


“COMMUNICATIONS” means, without limitation, the transmittal of information (in the
form of facts, ideas, inquiries, or otherwise) including without limitation oral, written,
graphic, and electronic communication, whether direct or through an intermediary.


“RECORDS” means any handwriting, typewriting, electronic mail (whether located on the
City’s servers or on any private server or personal account), text messages (whether located
on the City’s servers or on any private server or personal account), printing, photostating,
photography, photocopying, and every other means of recording any tangible thing, any form
of communication or representation, including letters, words, pictures, sounds or symbols or
any combination thereof, and any record thereby created, regardless of the manner in which
the record has been stored, including without limitation papers, maps, magnetic or paper
tapes, photographic films and prints, magnetic or punched cards, discs, or drums.


“RELATE” (or “RELATING” or “RELATED”) means, without limitation, constituting,
respecting, regarding, reflecting, concerning, pertaining to, stating, establishing, showing,
describing, recording, noting, embodying, memorializing, mentioning, studying, analyzing,
discussing, consisting of, containing, evidencing, depicting, or referring in any way, directly
or indirectly, to the subject matter of the request.


Request:
1. ALL COMMUNICATIONS to or from Dan Keen that include the following persons:
Claudia Quintana, Shannon Eckmeyer, Teri Kilgore, Will Morat, Ron Gerber, Jose
McNeill, or Slater Matzke, whether individually or in any group, from August 1, 2017
to present.


2. ALL COMMUNICATIONS to or from Craig Whittom RELATING to Vallejo
Marine Terminal, Orcem, General Mills, Cherokee Brooks, the General Plan
Working Group (which may be described as the “GPWG”), General Plan Update, or
Propel Vallejo from January 1, 2015 to June 30, 2016.


3. ALL COMMUNICATIONS to or from Eric Zell that include the following persons:
Dan Keen, Claudia Quintana and Andrea Ouse, whether individually or in any
group, RELATING to Orcem, Vallejo Marine Terminal, Faraday Futures or the
recusal of City Council members from any vote from January 1, 2015 to June 30,
2017.

With regard to all of the above requested documents, the public records we seek include all
writings prepared, owned, used, received, or exchanged by the City regardless of physical
form or characteristics.


If you find any of these requests insufficiently focused or effective, we ask that you provide
the assistance required by Government Code § 6253.1, including “assisting the member of the
public to identify records and information that are responsive to the request or to the purpose
of the request.” If you believe any portion of the records we have requested is exempt from
disclosure by express provision of the law, Government Code § 6253(a) additionally requires
segregation or deletion of that material and the release of the remainder of the information.
The Public Records Act requires that you respond to this request within ten (10) days. For
any responsive public record kept in electronic format, we request that an electronic copy of
the document be produced in that format, pursuant to Government Code § 6253.9. Otherwise,
please notify me by phone or email when any portion of the documents are ready, and I will
arrange for their pick up by courier. Also, please notify me as to the reasonable copying
costs, and I will promptly send payment.


If documents are voluminous, then please indicate in your response the approximate volume
of documents responsive to this request, and the location, dates, and times upon which
inspection will be permitted. If you can provide documents in response to one or more of the
above requests sooner than for others, please provide the electronic copy to me once available
or please so indicate, and I will arrange for their pick up as such documents become available.
