Dear Custodian or Records for the Vallejo Police Department and the Vallejo City Attorney:

 

On behalf of my client, Mr. Robert Connelly (VCR231987), I am seeking all of the following records related to Officer Jarrett Tonn, pursuant to SB 1421 and the California Public Records Act (Government Code Section 6250 et. seq.):

 

  1. Records relating to the report, investigation, or findings of any incident involving the discharge of a firearm at a person by a peace officer or custodial officer.

 

  1. Records relating to the report, investigation, or findings of any of incident in which the use of force by a peace officer or custodial officer against a person resulted in death or great bodily injury.

 

  1. Records relating to an incident in which a sustained finding was made by any law enforcement agency or oversight agency that a peace officer or custodial officer engaged in sexual assault involving a member of the public. "Sexual assault" is defined for purposes of the statute as the "commission or attempted initiation of a sexual act with a member of the public by means of force, threat, coercion, extortion, offer of leniency or other official favor, or under color of authority.  For purposes of this definition, the propositioning for or commission of any sexual act while on duty is considered a sexual assault."
  2. Records relating to an incident in which a sustained finding was made by any law enforcement agency or oversight agency of dishonesty by a peace officer or custodial officer directly relating to the reporting, investigation, or prosecution of a crime, or directly relating to the reporting of, or investigation of misconduct by, another peace officer or custodial officer, including, but not limited to, any sustained finding of perjury, false statements, filing false reports, destruction, falsifying, or concealing of evidence.

On May 8, 2019, we received your request dated May 6, 2019.  Below is your request, and our response is as follows:  

  

 I am seeking all of the following records related to Officer Jarrett Tonn, pursuant to SB 1421 and the California Public Records Act (Government Code Section 6250 et. seq.):  

  1. Records relating to the report, investigation, or findings of any incident involving the discharge of a firearm at a person by a peace officer or custodial officer.  

 
 

  • We have located three cases involving Officer Jarrett Tonn – VPD case 17-7037, 17-8723, and 15-2436.  The information you requested is part of the rolling production related to records available under SB 1421.  Due to the voluminous records requested, the need for redactions under Penal Code section 832.7(b)(5)-(6), we will provide you a further response on or by June 27, 2019. 

 

 

  1. Records relating to the report, investigation, or findings of any of incident in which the use of force by a peace officer or custodial officer against a person resulted in death, or great bodily injury. 

 

  • We are continuing to review our records in an attempt to locate and review responsive documents.  The information you requested is part of the rolling production related to records available under SB 1421.  Publicly available documents that you requested will be produced.  However, due to the voluminous amount of separate and distinct records requested here, we expect to give you a further response on or by June 27, 2019. 

 

  1. Records relating to an incident in which a sustained finding was made by any law enforcement agency or oversight agency that a peace officer or custodial officer engaged in sexual assault involving a member of the public.
