To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

- A copy of all policies in use now or at any time in the last five years which controlled the use of premium travel. These records should include, but not be limited to the procedure for booking first class airfare, the conditions which must exist to book first class airfare, all blank forms used in requesting first class airfare, and all records concerning the use of first class airfare to accommodate a medical condition such as what burden of proof is required to show a medical need.
- Any known violations of these policies and the corrective or disciplinary actions, if any, that were taken to address the problem.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Dear Mr. Rubins,


Thank you for acknowledging that item 1 in your request has been fulfilled.


With regard to item 2, I consulted with City staff on whether the City has a program that automatically checks standard travel expenses.  The City does not have such an automated travel expense software, but manually reviews expense reports.


City staff have also conducted an extensive search for any employee violations of travel policies, and the corrective or disciplinary actions taken to address the problem.  The City has not located any records responsive to this part of your request.  Please be assured that City staff made every effort to find these records and to respond effectively to your request.


As no records exist responsive to item 2, the City deems this request complete.  Please let me know if you have any questions or would like additional clarification on anything.  Thank you.

This request has STILL not been acknowledged, despite being submitted on June 17 to the City Manager's Office email inbox. The statutory deadline for a response is already passed. May I remind you that the California Public Records Act (Cal. Gov’t Code § 6253(c)) specifically requires that an agency provide a response to a public records request within ten business days of receipt of that request. By failing to respond to this request within the legally-mandated timeframe, this agency is in violation of the law. Please provide acknowledgement of this request and the responsive materials forthwith. If such materials cannot be produced, please provide an appropriate explanation for this rejection, as is dictated by this agency's legal obligations under the California Public Records Act.
