Pursuant to the California Public Records Act, I hereby request the following records:

For all city elected officials, attorneys working in the Office of the City Attorney, and supervisory officers in the Vallejo Police Department:
1. Employment contracts (see International Federation of Professional and Technical Engineers v. Superior Court, 42 Cal.4th 319, 64 Cal. Rptr. 3d 693, 165 P.3d 488 (2007); see also Cal. Gov't Code § 6254.8)
2. Current and historical salary information (see Int’l Federation, 42 Cal.4th at 329)
3. Public pension amounts (see Sacramento County Employees’ Retirement System v. Superior Court, 195 Cal. App. 4th 440, 468; 125 Cal. Rptr. 3d 655 (2011))
4. Personnel records, with a minimum but appropriate amount of redactions necessary to protect sensitive information like home address or telephone number (see Braun v. City of Taft, 154 Cal. App. 3d 332, 343-34, 201 Cal. Rptr. 654 (1984))
5. Resumes and job applications (see Eskaton Monterey Hospital v. Myers, 134 Cal. App. 3d 788, 794, 184 Cal. Rptr. 840 (1982))
6. Disciplinary records (see Bakersfield City School Dist. v. Superior Court, 118 Cal. App. 4th 1041, 1046, 13 Cal. Rptr. 3d 517 (2004))

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Rubins,


The City is releasing salary tables responsive to item 2 of your request.


On item 4 of your request, you have clarified you are interested in records related to “serious deviations from acceptable behavior in an employment environment” for the individuals listed in your request.  The City does not maintain files on the misconduct of elected officials, and the attorneys in the City Attorney’s office do not have any records related to such offenses.  For police officers, any records disclosable under SB 1421 are on the City’s website in the link outlined in your prior correspondence. Therefore, the City deems item 4 of your request complete.


The City is continuing to search for, collect, and review records responsive to this request.  The City expects to produce disclosable records subject to any applicable exemptions, if any, by the next production date of 9/30/19.  If the City is able to make records available prior to this, we will do so.  Likewise, if additional time will be needed to complete the review and redaction of the responsive documentation, we will so notify you in writing.  Thank you very much for your cooperation.

1. As discussed, the standard form contracts and executive employment contracts are available on the City of Vallejo's website. I consider this item complete.

3. As discussed, this information is available from CalPERS.

4. As discussed, for police employees, please limit the records to the categories of offenses listed in the text of SB 1421. For non-police employees, please provide information of a similar nature - serious deviations from acceptable behavior in an employment environment.

6. As discussed, I was pleased to hear that no responsive records were located for City Attorney's office employees. Police records (PC 832.7 records) are available online:

This request has STILL not been acknowledged, despite being submitted on June 17 to the City Manager's Office email inbox. The statutory deadline for a response is already passed. May I remind you that the California Public Records Act (Cal. Gov’t Code § 6253(c)) specifically requires that an agency provide a response to a public records request within ten business days of receipt of that request. By failing to respond to this request within the legally-mandated timeframe, this agency is in violation of the law. Please provide acknowledgement of this request and the responsive materials forthwith. If such materials cannot be produced, please provide an appropriate explanation for this rejection, as is dictated by this agency's legal obligations under the California Public Records Act.
