Pursuant to the California Public Records Act and the Vallejo Sunshine Ordinance (Ord. 1426 N.C.(2d) § 1 (part), 1999.), I hereby request the following records:

For all cases settled or closed in the last 5 years: matter or case identifier, counterparty name, filing or initiation date, closure date, any amount paid to counterparty, accrued internal legal fees (if tracked), external legal fees, and counterparty legal fees (if recovered).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter.

I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

As you may be aware, the PRA permits a local agency to withhold certain records that are exempt from disclosure.  Please be advised, the City is withholding certain records from disclosure, in whole or in part, pursuant to the following exemption:

 

Records containing certain confidential financial information, such as bank account information, federal tax identification numbers, and/or other confidential financial information is exempt because public disclosure of such information could compromise the security of the bank account and/or other financial interests, and could expose the City to liability. Therefore, the public interest served by withholding this information outweighs any public interest served by disclosure, and the exemption is incorporated into the Public Records Act through California Government Code Section 6255.

 

The Public Records Act requires the City to provide a written response when a records request is denied, either in whole or in part. (Gov. Code § 6255, subd. (b).) The Public Records Act also requires that notification of denial of any request for records must include the names and titles or positions of each person responsible for the denial. (Gov. Code § 6253, subd. (d).) With the name and title provided below, this correspondence fulfills both of the aforementioned legal requirements.

The City is continuing to search for, collect, and review records of settlement agreements and checks paid.  The City expects to produce disclosable records subject to any applicable exemptions to you by September 13, 2019.  If the City is able to make records available prior to this, we will do so. Likewise, if additional time will be needed to complete the review and redaction of the responsive documentation, we will so notify you in writing.

This request has STILL not been acknowledged, despite being submitted on June 19 to the City Manager's Office email inbox. The statutory deadline for a response is already passed. May I remind you that the California Public Records Act (Cal. Gov’t Code § 6253(c)) specifically requires that an agency provide a response to a public records request within ten business days of receipt of that request. By failing to respond to this request within the legally-mandated timeframe, this agency is in violation of the law. Please provide acknowledgement of this request and the responsive materials forthwith. If such materials cannot be produced, please provide an appropriate explanation for this rejection, as is dictated by this agency's legal obligations under the California Public Records Act.
