To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

All available misconduct records or serious use-of-force investigations regarding former Vallejo Police Department detective Sean Kenney, Officer Ryan McLaughlin, Officer Steve Darden, and Officer Matthew Komoda over the course of their careers with the department.

Please note that under Senate Bill 1421’s amendments to California Penal Code sections 832.7 and 832.8, certain types police misconduct records are now public records under California law. These records include:

- Records related to any incident where a law enforcement officer fired a gun at a person (regardless of whether someone was hit), or used force that resulted in serious injury or death.

- Records related to incidents where the agency found that an officer committed sexual assault against a member of the public—which includes attempts to coerce sex or proposition sex while on duty.

- Records related to incidents where the agency found that an officer engaged in dishonesty in the investigation, reporting, or prosecution of crime or police misconduct. This kind of dishonesty could include filing a false report, testifying untruthfully, or planting evidence.

I therefore request any such records concerning the aforementioned officers during their employment at the Vallejo PD.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. The requester is a full-time reporter at Reason Magazine who covers criminal justice.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

The City is continuing to diligently research its records to gather responsive documents and prepare them for production.  We are currently working on gathering, reviewing and redacting Officer Involved Shooting cases (Penal Code section 832.7(b)(1)(A)(i)) from 2014 – 2017. See the list of cases below.  This production will include all publicly available information under Penal Code section 832.7(b)(2).  We will also be gathering an inventory of electronic records associated with these files.   

 

Due to the voluminous records requested, the need for redactions under Penal Code section 832.7(b)(5)-(6), we estimate these items will be available by June 27, 2019.   

 

Once the case documents are complete, they will be publicly available on our website at http://www.cityofvallejo.net/cms/One.aspx?portalId=13506&pageId=15359557 and you will be notified as such.

  • We are reviewing our records in an attempt to locate and review responsive documents.  Publicly available documents that you requested will be produced.  However, due to the voluminous amount of separate and distinct records that are requested here, we expect to give you a further response on March 15, 2019 (14 additional days from the day due), in accordance with Government Code section 6253(c).
