Hi, Mr. Wager-Smith.I received your request for a public record. You have requested the following from the time period of January 1, 2015 to March 5, 2020:

1.)  Any and all documents referring to, referencing, or evidencing any communication between VHA and HARBOR PARK APARTMENTS, LP (California Secretary of State File No.:201632000008), including any employee, agent, representative, principal, or successor, of said partnership relating to:

a.) The condition, operation, and/or maintenance of Harbor Park Apartments, located at 961 Porter Street, Vallejo, CA.;

b.) Compliance by Harbor Park Apartments, located at 961 Porter Street, Vallejo, CA.,with any and all housing authority rules, regulations, statutes, codes, ordinances, proclamations, and recommendations, including, but not limited to all notices, correspondence,audits, reports, applications, citations, decisions, and inspections.

2.) Any and all documents referring to, referencing, or evidencing any communication between VHA and ALLIANCE COMMUNITIES, INC., (California Corporation No.:C3199333), including any employee, agent, representative, or subsidiary of said partnership, relating to:

a.) The condition, operation, and/or maintenance of Harbor Park Apartments, located at 961 Porter Street, Vallejo, CA.;

b.) Compliance by Harbor park Apartments, located at 961 Porter Street, Vallejo., with any and all housing authority rules, regulations, statutes, codes, ordinances, proclamations, and recommendations, including, but not limited to all notices, correspondence, audits, reports, applications, citations, decisions, and inspections.

3.) Any and all documents referring to, referencing, or evidencing any communication between VHA and M2 Vallejo 178, LP., (California Secretary of State File No.: 200620900007), including any employee, agent, representative, principal, or successor, of said partnership, relating to:

a.) The condition, operation, and/or maintenance of Harbor Park Apartments, located at 961 Porter Street, Vallejo, CA.;

b.) Compliance by Harbor park Apartments, located at 961 Porter Street, Vallejo., with any and all housing authority rules, regulations, statutes, codes, ordinances, proclamations, and recommendations, including, but not limited to all notices, correspondence, audits, reports, applications, citations, decisions, and inspections.

The California Public Records Act, Government Code §6250, et seq., gives you the right to obtain a copy of identifiable public records. Government Code §6256 provides that the City has up to 10 days after receipt of your request to determine whether to comply with your request and shall immediately notify you of this determination and the reasons therefore.

The City has determined it has documents responsive to your request, which it is releasing to you today.

Your request will require City staff to search for, collect and examine a large number of documents to locate responsive records.  Under the PRA, a request which creates a need to search for, collect and appropriately examine a “voluminous amount of separate and distinct records” is one of the conditions that creates “unusual circumstances.”  (Government Code section 6253(c)(2).)  Under such circumstances, the City may take an extension of the standard 10-day time period provided under the PRA for making its determination on a request for records. 

The City is searching for, collecting, and reviewing records responsive to this request. The City will provide you with disclosable records subject to any applicable exemptions in accordance with the following production schedule: April 30, May 30, June 30.

If the City is able to make the records available prior to the production schedule dates indicated above, it will do so. Alternatively, if additional time will be needed to complete the review and redaction of the responsive documentation, the City will notify you in writing. On March 16, 2020 the City Council declared a local emergency in response to the global COVID-19 outbreak. The City has sent employees home over concerns of the spread of COVID-19 and City operations have been interrupted. Due to these emergency circumstances, the City’s response to your Public Records Act request may be delayed. We expect to address your PRA request when normal business operations resume. Thank you for your patience in these unprecedented times.

On 3/05/2020, you requested records as outlined in our previous message and in your letter. Pursuant to California Government Codes section 6253, the City of Vallejo shall, within 10 days from the receipt of the request, determine whether the request, in whole or in part, seeks copies of disclosable public records in the possession of the agency.

Under certain limited circumstances, the city may extend this time limit. With regard to your request, the City will make a determination by 3/31/2020.This extension is necessary due to the need to search for, collect, and the need to examine a voluminous amount of separate and distinct records of that are demanded in a single request.
