The City of Vallejo does not maintain records related to specific animals that visit the Humane Society of the North Bay. However, the City contracts with the Humane Society of the North Bay for local sheltering services. The contract includes the following language:
HSNB will accurately and legibly maintain all animal records and documents (Animal Control Services). HSNB understands that the California Public Records Act or other applicable law may compel the disclosure or production of records relating to this Agreement. Upon reasonable request by the City, HSNB will allow City representatives access to HSNB records and documents (i.e. financial, animal, etc.) for any lawful purpose, including compliance with the California Public Records Act or any applicable law. Personnel records, attorney/client privileged documents and any other exempted material will not be disclosed to any requestor, unless disclosure of this information is compelled or warranted by law. In the event a request for HSNB records is received by the City, City will promptly notify HSNB of the receipt of the request in order to afford HSNB with an opportunity to oppose disclosure. Any opposition to the disclosure must be in writing, articulating a legal basis for nondisclosure. The City attorney will consider the basis for any such opposition prior to reviewing or issuing the City’s timely response to the request for production of records.”
An e-mail was sent to the Director of the Humane Society of the North Bay on January 7, 2020, to find out if their was an identifiable record. It is the City's responsibility to request the record, and the Contractor's responsibility to produce a record if one exists. On February 4, 2020 a record was produced and is attached.
